Understanding Pennsylvania’s felony laws

The criminal code in Pennsylvania places the most serious crimes into two categories: felonies and noncategorized crimes. The code divides felonies into three degrees:

  • First degree: Arson that endangers persons, rape and kidnapping are examples of first-degree felonies. These crimes may have statutory minimums, but sentences may not exceed 20 years in prison and $25,000 in fines.
  • Second degree: Statutory sexual assault and burglary of an unoccupied structure are felonies of the second degree. Sentences cannot be for more than 10 years in prison and $25,000 in fines.
  • Third degree: A terroristic threat is a felony in the third degree. Sentences for these crimes are limited to seven years in prison and $15,000 in fines.

However, the most serious crimes are noncategorized. These include first-, second- and third-degree murder of an individual or an unborn child. Pennsylvania has the death penalty for a first-degree murder conviction and life in prison for murder in the second degree.

Lesser crimes in Pennsylvania are categorized as misdemeanors.
